Terms of Use – Hana Breathe

These Terms of Use (“Terms”) govern use of the Hana Breathe application (“app” or “service”) and the relationship between you and the operator. By using the app, you agree to these Terms.

1. Operator

The service is operated by David Vurbs, Horní Slivno 25, 294 79, Czech Republic, ID No.: 05405289 (“operator”).

2. Subject matter and scope

• Hana Breathe is intended for breathing exercises and related content (guidance, statistics, motivation).
• Some content is available free of charge; some is available under the paid Hana Journey subscription (“subscription”).
• The service is provided to the extent and with the features described in the app and on hanabreathe.com. The operator may develop, limit, or temporarily suspend the service, with regard to users’ interests.

3. Registration and account

• Full use of the service (history, streaks, sync) requires an account. You can create an account by signing in with email (one-time code) or via Apple/Google.
• You must provide accurate information and keep your account secure. You are responsible for activity on your account.
• You may delete your account in the app or by contacting the operator (david@hanabreathe.com). After deletion, the operator may retain data only as permitted by law and the Privacy Policy.

4. Hana Journey subscription

• The subscription unlocks paid content (more breathing exercises). Monthly or annual plans are offered; the annual plan is discounted by roughly the equivalent of two months compared to paying monthly.
• Purchase and payment are processed through the App Store (Apple). Apple’s rules apply to subscriptions and refunds. Prices and currency are shown in the App Store before you confirm the purchase.
• Renewal: The subscription renews automatically for the next period until you cancel it in your subscription settings in the App Store.
• Cancellation: You cancel on your device (Settings → Subscriptions / Apple ID). After cancellation, paid content remains available until the end of the period you have already paid for.
• Refunds: Apple handles complaints and refunds under its rules; you may also contact the operator (david@hanabreathe.com) for information or to pass on a request.

5. User rights and obligations

• You may use the app only in accordance with these Terms and applicable law. You must not misuse the service, circumvent technical limits, distribute harmful content, or disrupt the service or third-party rights.
• The app is for personal, non-commercial use. Bulk downloading, automated scripts, or systematic copying of content is not allowed without the operator’s prior consent.

6. Intellectual property and licence

• All rights in the app, content (texts, guidance, design, logos), and technology belong to the operator or its licensors. You receive only a limited right to use the app and accessible content for as long as the service is provided under these Terms.
• No part of the service (including texts and graphics) may be copied, distributed, or otherwise used outside normal in-app use without the operator’s written consent.

7. Limitation of liability

• The service is provided “as is”. The operator does not provide medical or legal advice. Breathing exercises may support relaxation and wellbeing; you alone decide whether they are suitable for you (especially if you have health concerns) and should consult a doctor if unsure.
• The operator is not liable for service interruptions due to technical reasons, maintenance, or changes outside its direct control (including outages at Apple, hosting, or networks). To the maximum extent permitted by law, liability for intent and gross negligence is not excluded; liability for lost profits and indirect damage is excluded to the extent permitted by law.

8. Personal data

Processing of personal data is governed by the Privacy Policy (hanabreathe.com/privacy). By using the service, you confirm that you agree to it.

9. Changes to the Terms

• The operator may change these Terms. The current version will be published on this page (hanabreathe.com/terms); for material changes, the operator may also notify you in the app or by email.
• Continued use of the service after changes take effect constitutes acceptance. You may reject the changes by stopping use of the service and cancelling your account / subscription.

10. Final provisions

• The relationship between you and the operator is governed by the law of the Czech Republic. Disputes fall under the courts of the Czech Republic; consumers may also contact the relevant supervisory body (e.g. Czech Trade Inspection Authority).
• If any provision of these Terms is invalid or unenforceable, the remaining provisions remain in effect.
• These Terms take effect on the date they are published on this page.
